Terms of Service

§1. General provisions

These Terms of Use set out the rules for using the GymNote website available at https://gymnote.fit and the GymNote mobile application (the “Application”).

Using the website and the Application means you accept these Terms of Use and the Privacy Policy.

The owner and administrator of the service is Pawel Gol.

§2. Scope and nature of the service

The GymNote Application allows users to record, analyse, and review workouts in the form of a digital note.

Full functionality requires creating an account.

The service is intended for users aged 16 or older.

§3. Premium subscription

GymNote offers free features and an optional Premium subscription with additional functionality.

Free tier:

• Basic workout logging remains free
• No time limit on free features

Pricing:

• Current prices are displayed in the app before purchase
• Prices are set in App Store Connect and may vary by region
• All prices include applicable taxes

Billing:

• Subscriptions are billed monthly or annually (as selected)
• Payment is processed through Apple via your Apple ID
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period

Cancellation:

• Cancel anytime via iOS Settings > Apple ID > Subscriptions
• Or via the App Store app > Account > Subscriptions
• Access continues until the end of the paid period
• Deleting the app does not cancel your subscription

Refunds:

• Refund requests must be submitted directly to Apple at reportaproblem.apple.com
• Apple's refund policy applies to all purchases
• We cannot process refunds directly

§4. Right of withdrawal

If you are a consumer in the European Union, you have the right to withdraw from a distance contract within 14 days without giving any reason.

For in-app purchases made through the App Store:

• Apple processes all payments and refunds
• To request a refund, visit reportaproblem.apple.com
• Apple's refund policy applies to all App Store purchases

By making a purchase and using the subscription immediately, you acknowledge that:

• The digital content/service begins immediately after purchase
• You expressly consent to this immediate performance
• You acknowledge losing your right of withdrawal once the service has been fully provided

§5. Registration and user account

Users create an account using their email address and password or via an external identity provider (Apple Sign-In, Google).

Users must provide truthful information.

Users may delete their accounts at any time from the Application settings. Upon deletion, your workout data will be permanently removed.

The administrator may block or terminate an account if:

• These Terms of Use are breached
• Harmful, illegal, or abusive activity is detected
• The account is used for unauthorized automated access

Before termination (except in cases of serious violations), you will receive a warning and opportunity to export your data.

§6. Intellectual property

Your content: You retain all rights to the workout data and personal content you enter into the Application.

Our content: GymNote grants you a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes.

All GymNote branding, design, code, and intellectual property remain the property of Pawel Gol.

You may not:

• Copy, modify, or distribute the Application
• Reverse-engineer or decompile the Application
• Use automated systems to access the service (scraping, bots)
• Remove or alter any proprietary notices

§7. Prohibited conduct

When using GymNote, you agree not to:

• Upload illegal, harmful, or offensive content
• Attempt to gain unauthorized access to other accounts or systems
• Use the service for any unlawful purpose
• Interfere with or disrupt the service or servers
• Circumvent any security or access restrictions

§8. Liability

The administrator is not responsible for content entered by users or for training decisions made based on that content.

The Application is informational only and does not constitute medical or fitness advice. Consult a healthcare professional before starting any exercise program.

The administrator does not guarantee uninterrupted operation of the service or full compatibility with every device. Scheduled maintenance may occasionally affect availability.

This limitation of liability does not affect your statutory consumer rights under Polish and EU law, which cannot be excluded or limited.

§9. Complaints and disputes

Complaints: Send to gymnotepl@gmail.com. We will acknowledge receipt and respond within 14 days.

Online Dispute Resolution: EU consumers may use the European Commission's ODR platform at https://ec.europa.eu/consumers/odr

We aim to resolve any disputes amicably before initiating formal legal proceedings.

§10. Personal data

Personal data is processed in accordance with our Privacy Policy.

The data controller is Pawel Gol.

§11. Final provisions

The administrator reserves the right to amend these Terms of Use. Users will be informed about material changes by email or within the Application at least 14 days before changes take effect.

If you do not accept the amended terms, you may terminate your account before the changes come into effect.

Polish law governs these Terms and any disputes arising from them.

For consumers, this choice of law does not deprive you of the protection afforded by mandatory provisions of your country of residence.

In case of discrepancy between the English and Polish language versions of these Terms, the Polish version shall prevail for users in Poland.
